Abstract
Le temps de travail est emblématique des évolutions possibles du droit social européen dans la confrontation entre droits de l’Homme et exigences du marché économique À partir de dispositions du Traité de la Charte et de directives de leur finalité de protection de la santé des travailleurs le juge de Luxembourg construit une jurisprudence importante sur la mesure du temps de travail le respect des repos minimums et de la durée maximale hebdomadaire de travail les recours aux dérogations et l’interdiction des discriminations Le droit du Conseil de l’Europe rappelle le nécessaire respect de normes protectrices de la santéThe issue of the regulation of working time is emblematic of the potential evolution which can occur in the area of European Social Law regarding the interaction between ensuring respect for human rights while at the same time heeding the exigencies of the economic market Having regard to the Treaty the Charter and the Directives and their stated goal of ensuring the protection of workers’ health and safety the Court in Luxembourg has built up a body of case law concerning the calculation of working time the respect for minimum rest periods as well as the maximum weekly working period permitted the application of derogations from the rules established and the correct implementation of the prohibition against discrimination In addition the body of law generated by the Council of Europe provides a frequent reminder of the necessity of respecting norms intended to protect workers’ health and safety
